Terms of Use for Zylo

1. Acceptance of Terms

These Terms of Use ("Terms") form a legally binding agreement between you and Zylo ("we", "us", or "our") regarding your use of the Zylo mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.

2. Description of the Service

Zylo is a mobile application designed to support motivation and goal tracking, including:

  • Daily motivational content and affirmations
  • Custom notification schedules
  • Streak and progress tracking
  • Personalized content categories
  • Premium features available via subscription

3. Eligibility

You must be at least 13 years old (or the minimum legal digital consent age in your country) to use Zylo. If you are under 18, you confirm that you have permission from a parent or legal guardian.

4. License Grant and Restrictions

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Zylo for personal, non-commercial purposes, subject to compliance with these Terms.

4.2 Restrictions

You agree not to:

  • Modify, reverse engineer, or decompile the App
  • Remove or alter proprietary notices
  • Use the App for illegal, harmful, or unauthorized activities
  • Attempt unauthorized access to Zylo systems
  • Use bots, scripts, or automation to access the App
  • Disrupt App services or servers
  • Copy, resell, distribute, or sublicense the App
  • Impersonate individuals or organizations
  • Upload malware or malicious code
  • Violate any applicable laws or third-party rights

5. User Accounts and Data

5.1 Account Management

Subscriptions and account access may be managed through RevenueCat and platform services (Apple or Google). You are responsible for keeping your account secure.

5.2 User Data

You retain ownership of content you create in Zylo. By using the App, you grant us permission to store and process data as outlined in our Privacy Policy.

5.3 Accuracy

You agree to provide accurate and up-to-date information when using Zylo.

6. Premium Subscriptions

6.1 Subscription Access

Some Zylo features require a paid subscription, billed through Apple App Store or Google Play Store.

6.2 Billing Terms

  • Payment is charged upon confirmation of purchase
  • Subscriptions renew automatically unless canceled
  • Renewal occurs within 24 hours before the current period ends
  • You can manage or cancel subscriptions in your App Store or Play Store settings

6.3 Free Trials

Free trials may be offered. If not canceled before expiration, charges may apply. Trial terms may change at any time.

6.4 Pricing Changes

We may update subscription pricing. Existing subscribers will receive advance notice when legally required.

7. Intellectual Property

7.1 Ownership

All Zylo content, software, branding, design, and technology are protected under intellectual property laws and remain the exclusive property of Zylo.

7.2 Third-Party Content

Some quotes or content may originate from public or licensed sources. We respect intellectual property rights.

7.3 User-Generated Content

You retain ownership of content you create. Some content may be stored locally on your device.

7.4 Trademarks

"Zylo" and associated branding are protected trademarks and may not be used without permission.

8. Wellness & Medical Disclaimer

8.1 No Medical Advice

Zylo does not provide medical, mental health, or therapeutic advice. Content is for informational and motivational purposes only.

8.2 Professional Support

Always seek qualified medical or mental health professionals for diagnosis or treatment.

8.3 Emergency Situations

If you are experiencing a mental health crisis, contact emergency services immediately:

  • EU: 112

  • Other countries: Use your local emergency hotline

Zylo is not intended for crisis support.

9. Disclaimer of Warranties

To the maximum extent permitted by law, Zylo is provided "AS IS" and "AS AVAILABLE." We make no guarantees regarding:

  • Accuracy or reliability of content
  • Uninterrupted or error-free service
  • Fitness for a particular purpose

EU consumer rights remain unaffected where required by law.

10. Limitation of Liability

10.1 EU Consumer Protections

Nothing in these Terms limits liability for death, injury, fraud, or rights protected under EU law.

10.2 General Limitation

We are not liable for indirect, incidental, or consequential damages, including lost data, profits, or emotional distress, where legally permitted.

10.3 Maximum Liability

Where allowed, total liability will not exceed the greater of:

  • The amount paid in the past 12 months, or
  • €100

11. Third-Party Services

Zylo may integrate third-party services such as RevenueCat, Supabase, Sentry, and PostHog. We are not responsible for third-party content, reliability, or policies.

12. Changes to the App or Terms

12.1 App Changes

We may modify, suspend, or discontinue Zylo at any time without liability.

12.2 Terms Updates

We may update these Terms periodically. Continued use means acceptance of updates.

13. Termination

13.1 By You

You may stop using Zylo at any time. Deleting the App does not cancel subscriptions.

13.2 By Us

We may suspend access if these Terms are violated.

13.3 Effect

Upon termination, your license ends, and certain legal sections remain in effect.

14. Geographic Availability

Zylo is operated from France and primarily targets users in the European Union. Users elsewhere are responsible for compliance with local laws.

15. Accessibility

We aim to make Zylo accessible to all users. Contact us if you experience accessibility issues.

16. Feedback

By submitting feedback, you grant Zylo a perpetual, royalty-free license to use it without compensation.

17. Apple & Google Platform Terms

Apple App Store

  • Apple is not responsible for Zylo
  • Apple may enforce these Terms as a third-party beneficiary

Google Play

Google Play usage is governed by Google's official Terms of Service.
